1. NATURE OF THE PLATFORM

1.1 Lead Generation and Directory Service
R8Works operates exclusively as an online directory and lead-generation platform. We connect Customers seeking home services (such as handyman, installation, and assembly services) with independent Service Professionals (“Pros”).

1.2 Not a Service Provider
R8Works DOES NOT provide home services, nor do we employ the Pros. R8Works is not a contracting agency, and we do not supervise, direct, or control the Pros’ work. The Platform is merely a venue that facilitates introductions.

2. INDEPENDENT SERVICE PROFESSIONALS (PROS)

2.1 Independent Contractor Status
All Pros listed on or connected through R8Works are independent contractors operating their own sole proprietorships or individual businesses. Pros are NOT employees, agents, or representatives of R8Works.

2.2 Direct Agreement
When a Customer requests a quote, the Pro will contact the Customer directly. Any agreement regarding the scope of work, scheduling, and pricing is a direct contract strictly between the Customer and the Pro. R8Works is not a party to this agreement.

2.3 Pro Responsibilities
Pros are entirely responsible for their own tools, methods of work, licenses, permits, and compliance with all applicable local and state regulations in California.

3. PRICING, QUOTES, AND PAYMENTS

3.1 No Platform Payments
R8Works does not process, collect, or manage payments for the home services provided. We do not act as an escrow service.

3.2 Pricing Agreements
Pros provide their own estimates and quotes directly to the Customer. The Customer and the Pro must independently agree on the final price before work begins. R8Works does not set, mandate, or guarantee any pricing.

3.3 Direct Payment to Pros
Customers must pay the Pro directly upon completion of the service (or according to the payment terms agreed upon between the Customer and the Pro). R8Works is never responsible for issuing refunds, nor are we responsible for mediating payment disputes, unpaid invoices, or uncollected funds.

4. CUSTOMER OBLIGATIONS & WORKPLACE SAFETY

4.1 Safe Working Environment
To ensure the protection of the Pros, Customers must provide a safe and suitable working environment. Customers agree to:

• Remove dangerous obstacles and secure areas that may pose a risk.
• Secure and leash pets while the Pro is on the premises.
• Disclose any hidden defects, structural weaknesses (e.g., fragile lath and plaster walls), or pre-existing damage in the work area.

4.2 Customer Supplied Materials
Customers are responsible for ensuring that all Customer-provided parts, appliances, and materials are compatible and in safe working condition. R8Works and the Pro are not liable for malfunctions or damage caused by defective or incompatible Customer-supplied materials.

5. LIMITATION OF LIABILITY AND DISPUTE RESOLUTION

5.1 General Limitation of Liability
To the maximum extent permitted by law, R8Works shall not be liable for any direct, indirect, incidental, or consequential damages arising out of the use of the Platform or the services rendered by any Pro.

5.2 Property Damage and Service Quality
Because R8Works does not perform the services, we do not guarantee the quality, safety, or legality of the work performed. R8Works shall not be liable for any property damage, secondary damage, injuries, or incomplete work resulting from the Pro’s services. Any claims for damages, warranties, or poor workmanship must be directed exclusively to the Pro who performed the work.

5.3 Release
In the event of a dispute between a Customer and a Pro, both parties release R8Works (and our officers, directors, agents, and employees) from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

6. REVIEWS, FEEDBACK, AND USER CONTENT

6.1 Leaving Reviews
Customers are encouraged to leave honest reviews regarding their experience with a Pro. Reviews must be truthful, respectful, and free of defamatory, abusive, or discriminatory language.

6.2 Ownership of Content
By submitting reviews, photos (including before-and-after project photos), or other content to the Platform, you grant R8Works a worldwide, royalty-free, perpetual, and non-exclusive license to use, display, reproduce, and distribute this content for promotional, marketing, and SEO purposes.

6.3 Moderation
R8Works reserves the right, at its sole discretion, to monitor, edit, or remove any reviews or user content that violates these Terms or is otherwise deemed inappropriate.

7. MODIFICATIONS TO TERMS

R8Works reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting to the Platform. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes.

By using the R8Works Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
